A grow kit is intended for cultivation, and the resulting mushrooms (Psilocybe cubensis) contain the illegal Class A controlled substances psilocybin and psilocin.
Legality of grow kits vs. spores in the UK
The legal status of different products related to psilocybin mushrooms hinges on whether they contain dormant spores or active, psilocybin-producing mycelium.
- B+ spores are legal for research: Spore prints or syringes containing dormant B+ spores can be legally sold and purchased in the UK for microscopy, research, or educational purposes. This is because the spores themselves do not contain psilocybin.
- Grow kits are illegal: A “grow kit” implies active cultivation. As soon as the spores germinate and produce mycelium within the kit, the culture becomes illegal because it contains psilocybin. Inoculated grow kits are explicitly banned under UK law.
UK law and penalties
- Class A drug: Under the Misuse of Drugs Act 1971, psilocybin and psilocin are Class A drugs, which carries the most severe penalties for possession and supply.
- Serious penalties: The maximum penalty for possession of a Class A substance is up to seven years in prison, an unlimited fine, or both. Supplying Class A drugs can lead to a maximum sentence of life imprisonment.
